WA Police – Driving with Medicinal THC

How can WA Police tell the difference between medicinal cannabis and illicit cannabis users? How does legally prescribed THC …

  1. Studies have shown that thc does not significantly affect driving anyway. Apparently its about the same difference as not having a cup of coffee in the morning, if you usually had one, and then driving…. The main observations they had of people driving on thc was that they were more patient and cautious than sober drivers… 😅 so why exactly is it illegal ?

  2. These people with the masks. they need to be on or off. Stop with the fake virtue signalling and make a decision to either keep it on or take it off. All that touching of the mask is huge contamination risk. Also, this cop has no idea. on one hand they're not experts yet offer advice on driving with the presence of substances. The truth is that they have absolutely no idea how uniformly measure inebriation so they just arrest people are ruin lives because of supposed safety. Medical opioids pose the same risk yet don't get the same scrutiny. The summary of the opposition to THC is that people are still influenced by the religious groups and their backwards ideology. Banning a natural plant is not the right of any fellow man.

  3. its simple you are never impaired behind the wheel whilst stoned, and its up to the cops to prove you otherwise which they cant do , thats why they deem you impaired if they find any amount in your system , so i suggest it be made legal and we get a system similar to the usa where users must have weed cards prescribed by a gp, issued by the government as either a separate card or as an add on to your licence , if you have it no fine no crime if you dont there could be a fine. if your in an accident whilst stoned you have to prove once again there is impairment the current laws assume your guilty till proven innocent and the same goes for refusing a breathe or blood test if you refuse you lose your licence on the spot , this is illegal as its a presumption of guilt with no evidence if you did this with any other law it would be thrown out of court they have to prove not assume and beyond all reasonable doubt and . to prove a point id be willing to get smashed and probe non impairment as the only time i have ever had an accident is straight ive never had accidents stoned never and always passed the booze bus . Cannabis is only harmful when mixed with other substances so regulation is the only answer to this just as the usa does. and its idiots like this cop who have no idea what their talking about who use any reason to fine charge jail anyone as they are the ones drunk. drunk on power as we all saw during covid ever so willing to harm aussies to keep them safe bully beat strangle bash and shoot aussies for their own good . the laws will never change as long as control freaks like him have power .

  4. as a lifetime consumer of Cannabis, and now as a medicinal user , i worry every time i get behind the wheel the following day from having my LEGAL medicine, that i will test positive fot THC, even tho i do not have any imparment to my driving, and im wondering that since the law states illicit drugs, and my drugs are indeed licit the law regarding mere presence in my system of THC, i should be exempt if unimpaired, its either that and i dont drive at all for any reason and i try to hitch-hike to the shops then back carrying fifty kilos of shopping, with the risks associated with that , including sunstroke and other possible medical events

  5. I am a responsible medicinal cannabis patient, i had a valid prescription and the police officer didn't even want to look at it. I have asked the politicians they passed the buck, so then i asked the police they also passed the buck so then i asked the attorney general as i was told he was the person that can change the law, and low and behold he also passed it on to the health department for thete opinion. Im a otherwise lawful person but the law is making me a criminal, for using a natural medication that is prescribed by a doctor and i get it from the pharmacy or the pharmacy sends it to me via Australia Post.

  6. There is no clarity for cannabis use medical or otherwise while driving , all that matters is to have cannabis in your system is enough to give rise to a offence .. but if your under o.5 alcohol level that’s okay to drive , typical double standards and what’s socially acceptable .. A easy recommendation would be to have cannabis measured for impaired driving just like alcohol… it’s not brain surgery , it’s common sense … but my suspicions is it’s more about revenue more than road safety .

  7. There is no roadside 'impairment test' that a stoned person couldn't pass – cannabis simply does not affect motor coordination like alcohol. Nor does it cause the overconfidence and impulsive decision making of alcohol. There is no level of THC in the blood that is a reliable indicator of impairment – everyone has different levels of sensitivity to it and tolerance changes everything. Therefore there is no reliable way to judge impairment from cannabis that is worthy of a court of law. Period. That's why they have to resort to simply the presence of THC at all, which is absurd as this can remain days after any impairment is gone. And no evidential argument has ever been made that THC even presents a significant problem for driving – that's just assumed while the evidence says different. This cop wants clarity about how to judge cannabis impairment, but he doesn't want the law changed? How about this: Is the person driving dangerously? No? Then you don't need to arrest them for being a weed smoker. And if you can't tell if they are impaired or not, then maybe that means that you don't need to wreck their lives with a drugged driving conviction?

In NZ the police warned us about a study that said cannabis gives a 2x greater chance of a crash, that was removed since their own literature says that alcohol give a 17x greater chance at the LEGALLY ALLOWED level. Oops. Hey I know, instead of asking the cops what they think, maybe we could base our policy on scientific evidence? There's plenty of it on weed and driving and the clarity of the conclusion is clear: there is no significant danger that needs to be policed at all. Solution: stop unnecessarily persecuting weed smokers, there is no need for testing. Just another scary cannabis bogeyman under the bed that our society is slowly waking up from…

  8. That was an interesting conversation. The sooner they change the rules for medicinal users from presence to impairment the better. I am a prescribed CBD user but the thought of testing positive roadside means I am restricted to pure CBD oil only, which restricts my options. If they changed the laws to impairment and not presence then my options increase tenfold as there are many more oils with 3%> thc in them.

  9. The issue is not the legislation or law it is the interpretation of said legislation or law …
The sad fact is the police interpret it in a biased manner…

  10. Like alcohol and driving. I’m expected to kinda guess I’m ok to drive when I used to drink. When considering driving on Cannabis the same judgement is used to determine whether I’m too high to drive. If I think I am I simply do not drive! Although that’s not the end, is it. There’s the issue of the presence of thc in the Police’s tests but no sign of impairment or effect of thc on the driver. You can get done for thc while driving 12 hours after your last consumption of thc. It’s ridiculous! How is the average person expected to manage their cannabis consumption and driving appropriately with laws like that?

  11. How stupid are these folks. The cop has said they have an impairment test that can be used to charge someone if their driving is impaired yet they still may be under 0.05. Wouldn't it be logical to put the question to the officer would it, in your opinion be, if a driver were driving in a manner that suggests impairment and they were subsequently drug tested and it was found they had cannabis in their system they should then be charged? This would then allow users of cannabis to drive and not be charged unless their driving was impaired by observable evidence rather than having a trace amount in their system which can trigger an alert even when they are not driving impaired? As the chair of this inquiry stated if the mere existence of it were enough to be charged then would n't the same logic be that an alcohol level should then be zero? It should be amount impairment, not the existence of the drug.

  12. I put in a 6-page complaint about the police not upholding the law. Not attending 000 calls and so many things. Telling me it's their choice on what laws they can choose to uphold. I sent it to the ACC which pressured the police to do an internal investigation. When I went to that I was chested out by a big cop and my girlfriend was forced to take my spot. Against her will saying I had put the complaint. She had just sent the test page for the fax. I went to the Ombudsman who opened a case. When I rang back to find out anything. The lady doing my case no longer worked there and they don't know what happened to my case. Yet they knew who had my case to start with, is telling. I wrote to the Governor General saying what has happened. I got no reply back. We as people can't hold them accountable. Yet they have held me accountable for every last mistake I have ever made. I had a breakdown over it. I have court in two months for having THC in my oral test I have a card I had a cone the day before. So my kids have to walk everywhere now. I can't afford to get shopping dropped off. So it has f*** my life. I don't drink, I'm so mad because of the drugs I can drive on I really shouldn't drive yet it's fine by them. Some of my cases were in the Newspapers until it came out the other side had made it all up. Then I lost my will, I saw how broken it is.

  13. It's okay to drink a little alcohol, but alcohol is probably hundreds of times more dangerous than a person who has smoked cannabis and driven a car and still has complete control of their mind and body.
It's okay to take prescription drugs.
    You are corrupt.
    Get out of our country.

  14. lack of clarity is your perception of reality. You cant see whats right and wrong? So why are you enforcing laws onto all of us? Go find another job you useless @#@%$%S!!

  15. Well I have to say I'm extremely dissapointed in the WA police as a medical cannabis patient who was just punished last month… which has ruined my career and all current prospects, i'll probably end up homeless soon as well. I have a prescription and I am one of those people who was just living my life… Doing nothing wrong. Trying to build a career. But you took one look at me and judged me and just threw the book at me.
Honestly go to hell WA police. Go to hell, all of you who agree to enforce this law. You are not contributing to society you are making it worse. Unlike what I was doing and you've now taken that away from me. Don't complain at me when i'm on centrelink for the rest of my life, it's because of your ignorance, don't try to say i'm a criminal when your law itself is criminal.
I even saw them let off another lady who also had a possession charge as well as driving charge. They said to her"Just show your evidence and lets forget it"
I went to court 5 times, i missed work every fucking time…. Because the court system and the police are both corrupt. I gave them a letter from my cannabis doctor and they did not care whatsoever. You are not contributing anything to our society you are ignorant and deserve to have everything taken away from you. Karma is the only law I follow. Good luck with that one.
Stop doing what youre doing and evolve your god damn consciousness. If you want to help the community how about you stop being a piece of shit, how about suggesting this law changes and stop acting like nazi dumb fucks? Thanks.
How many peoples lives have you ruined? How many people have committed suicide because you think being a nazi is helping anyone. Fuck off we don't even need you, everyone are already self policing mind controlled slaves. Maybe just go suck yourselves.

  16. That police officer contradicts himself, says one minute we will take into account medicinal and impairment, then says our officers are not qualified to judge impairment and we will charge you anyway

  17. My oil gets me stoned for 4-6 hours, yet I'm not allowed to drive until I stop my medicine for at least 4 days. And I've been told not to stop taking it, the law needs to change. I'm not going to prison for something that is out of my control.

  18. The Government of every state in Australia except Canberra is persicuting it's Citezens causing suicide mental health problems criminal convictions and soon all this will be a load of shit as the rest of the western world is laughing at us thankyou Government 🖕

  19. CBD oil has NO THC… So how can they seize the oil…. ? Imported or domestic ?
The system needs to update the laws.
Marijuana is legal to grow in small amount ( personal use ).
CBD oil is legal contains NO THC,, globally is a recognized as a medical assistance to anyone
Suffering from an illnesses that range from arthritis to cancer……. obviously it works for some, so how is it lawful to " legally "
confiscate the medicine without having any idea about the product. ??
This can and does cause people anxiety which when combined with the pre-existing conditions, can make the situation worse for the recipient/ patient , all because of the lack of '"common " education in the police force.
C'mon……. this type of thing has to stop right now…..!!!
People have the right to feel comfortable with their issues and if the CBD oil
Helps, then just let them have the pain relief they need……….. bit different if it was THEIR family members……
