    The U.S. has a rare opportunity to develop valuable expertise in an industry that is poised to grow globally over the coming years. That expertise could then be exported in a way that benefits the U.S., its cannabis related companies, and their tax-paying staff long term. That "predictable" tax revenue could then be used, in part, to help fund the fight against dangerous drugs and the treatment of addictions, further tipping the scales in favor of legally assessable cannabis. Continuing to handicap the industry only serves to hurt those operating within the law, while benefitting the criminals (many foreign) who tie up resources and contribute nothing of value to the economy or society.

All the License Producers have to do is move all employees to the plant production department so they can all qualified as Direct Labor Cost fully allowable for deduction.     Before we knew the rescheduling hearing was cancelled, Shane Pennington on yesterday's TDR podcast made the point that the rescheduling hearing record will be highly consequential to future litigation.
    And he also brought out that the DEA was not acting as a neutral party in good faith.

    Skip to today, The judge acknowledged the DEA's bias and dismissed the case because of it. He had critical words for the DEA and harshly rebuked them for their dishonest tactics. Had the rescheduling not been cancelled the DEA could have got lies and misrepresented data on the official record of the rescheduling that could have been very negative for the sector.

    โ€œEven among the numerous extraordinary and puzzling actions taken thus far by the Government during the course of this litigation, this disobedience of an unequivocal directive from the tribunal is unprecedented and astonishing,โ€ the judge added.

    Mulrooney also criticized the DEA for its actions, writing that โ€œthe specter of officials at the highest level of Agency management selectively assisting and granting access to individuals and groups standing in opposition to the [Notice of Proposed Rulemaking, or NPRM] it purportedly supports as the proponent, carries no small measure of discomfiture,โ€ he said. โ€œIf true, viewed in the best light, these allegations demonstrate a puzzling and grotesque lack of understanding and poor judgment from high-level officials at a major federal agency with a wealth of prior experience with the [Administrative Procedures Act].โ€

    In his ruling on Monday, Mulrooney noted a โ€œdisturbing and embarrassing revelationโ€ about claims of communications between DEA officials and groups opposed to marijuana policy reform. However, he said that even if the allegations are true, they do not amount to an โ€œirrevocable taintโ€ that would affect the outcome of the rescheduling process. As a result, the administrative law judge ruled that he did not have the authority to remove the DEA from the hearings as a proponent of the proposed rule change.
